NOTICE #2: All educational spiritual hypnosis teaching materials, session content, lectures, services, messages, and readings will be conducted solely upon the discretion of the Rev. Dr. Robert Fahey, Ph.D., and any topic shown or schedule to be performed is subject to change without notice. The teaching content of any one or more services whether provided in a private individual or group educational lecture series, hypnosis, self-hypnosis sessions, and/or any other event presentation defined verbally, and or provided in written materials in any form may change without notice and can do so only at the discretion of Rev. Dr. Robert Fahey as he alone will have the right to assess, design and present such teaching content. If for any reason, known, or unknown in advance that Rev. TERMS AND CONDITIONS: By agreeing to receive any one or more educational spiritual hypnosis service, message and or reading, or any other service resulting from any link on, to, or from this website, you agree that the service being provided, whether purchased for yourself, or you received as a gift is subject to your own interpretation. Any information provided (whether given in a message, reading, class, lecture, workshop, event, show, or through any other service or type of event listed on this website) does not constitute legal, psychological, medical, business, or financial advice. Choices, and/or actions based on the content of your session, sitting, message, reading, or service provided are your responsibility. The products and services provided by the Rev. Dr. Robert Fahey does not assume and hereby disclaims any liability to any person or entity for any loss or damages (including, without limitation, physical, mental, special, direct and or indirect, incidental, or consequential) caused in regard to any information and/or any suggestion, or advice provided in any given readings, products, or services regardless of whether resulting from negligence, accident, or any other cause whatsoever.

Agreement: To reserve either an Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s) appointment(s) with Robert Fahey, M.Ed., Ph.D. Please take your time prior to selecting and paying for your special services.

This Reservation agreement explains the rights and obligations that will exist between you and BioHealth Counseling Center, Inc., and with Dr. Robert Allen Fahey, Ph.D. once you make and pay for your selected services.

IN CONSIDERATION of BioHealth Counseling Center, Inc., / Dr. Robert Allen Fahey, Ph.D., and ATTENDANT agree as follows:

Regarding All Single Program and Individual Session Services

1. ATTENDANT is of legal age in the Country and/or State in which he/she enters this agreement (if minor the parent or guardian signature is required). He/She consider themselves to be an independent moral person in society and responsible for their own positive motivation, study habits, thinking, business operations and understands that by selecting and paying for any one or more Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s) appointment(s) or becoming involved in either one or both of the private and/or group psychic reading sitting services presented by the BioHealth Counseling Center, Inc., Founder ROBERT A. FAHEY, M.Ed., Ph.D., does NOT mean they are in any way to become an employee or legal representative for BioHealth Counseling Center, Inc., and/or its Founder ROBERT A. FAHEY, M.Ed., Ph.D.

2. ATTENDANT understands they are responsible for the full cost in advance of any one program, series of sessions, and or Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s), appointment(s) or readings being provided and/or being offered and if required any Federal and State taxes and/or licenses.

3. ATTENDANT agrees to use his/her best efforts to apply any part of the informational Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s), appointment(s) to bring about only positive conditions for common logical and moral sense motives.

4. ATTENDANT understands that the only expense incurred for any one or more Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s), appointment(s) being offered is the cost of the time of service provided. Purchase of optional items, books, pendulums, certificates if any are presented and wanted by the ATTENDANT can be obtained for a fee, but are NOT required.

5. The BioHealth Counseling Center, Inc., and/or its Founder ROBERT A. FAHEY, M.Ed., Ph.D., agree to make available only time to the ATTENDANT for Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s) appointment(s).

6. This agreement once accepted will become irrevocable by the ATTENDANT.

7. ATTENDANT acknowledges that the Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s), appointment(s) being provided whether performed LIVE, through telephone conference, via the Internet or in any other form does NOT provide any medical and/or psychological series, nor does it teach the ATTENDANT how to provide any medical and/or psychological services.

8. ATTENDANT acknowledges that ROBERT A. FAHEY, M.Ed., Ph.D., is NOT a medical doctor, but rather a psychic medium, an educational tutor and lecturer, hypnotist, and wellness and life coach and does NOT provide any medical and/or psychological services.

9. This agreement between the ATTENDANT, and the BioHealth Counseling Center, Inc., its Founder ROBERT A. FAHEY, M.Ed., Ph.D., will be governed by the laws of the State of Florida.

10. This agreement shall be deemed accepted by the BioHealth Counseling Center, Inc., and/or its Founder ROBERT A. FAHEY, M.Ed., Ph.D., upon issuance to the ATTENDANT of his/her first scheduled appointment and or reservation and acceptance date and/or time of private or group appointment and/or session and/or sitting message.

11. ATTENDANT understands in applying for any one or more Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s), appointment(s) he/she pledges NOT to use such information on themselves or any other person for any medical or psycho-therapeutic purpose requiring the supervision or assistance of a physician, dentist, qualified psychologist or other health practitioner unless he/she is working directly under such professional and strictly within the supervision practitioner’s area of competence. The ATTENDANT will NOT practice medicine, dentistry, psychology or offer any other professional services without proper training.

12. ATTENDANT understands that any problem of a medical or psychological nature may be treated legally only by medical doctors or other health practitioners in the healing arts. Psychic spiritual services may be used for therapeutic purposes only if such application is authorized by a licensed practitioner in the healing arts and only in cases in which the problem properly belongs in the specialty of the referring practitioner.

13. ATTENDANT believes that the Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s) appointment(s) he/she is seeking a reservation for can be helpful to him/her in achieving specific objectives with a twofold primary focus 1) to increase greater awareness of oneself, and 2) to enhance his/her life through general self-improvement.

14. ATTENDANT realizes the necessity to make a sincere and full commitment to the Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s), or appointment(s) for it to be optimally effective.

15. ATTENDANT fully understands that due to individual difference in ATTENDANT commitment and participation, the BioHealth Counseling Center, Inc., and/or its Founder ROBERT A. FAHEY, M.Ed., Ph.D., and staff can make no EXPRESS or IMPLIED warranties concerning and any one or more programs and/or services being offered or presented.

16. ATTENDANT fully understands the contents in either the Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s), or appointment(s) may vary from any verbal communications or material given prior to, during and/or after the actual presentation and that he/she now accepts this possible fact.

17. ATTENDANT understands and accepts that any one or more Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s), appointment(s) may be used during some parts of the all services being provided and the he/she now willingly releases the BioHealth Counseling Center, Inc., its Founder ROBERT A. FAHEY, M.Ed., Ph.D., and its staff from all liability as a result of any known and/or unknown mental, physical, emotional, financial, social enhancement or lack of before, during and/or after any given hypnosis, self-hypnosis or psychic spiritual services is provided except that result from wanton and willful misconduct.

18. ATTENDANT understands that the total current per person admission fee into the Gift Room, selected media room, Skype or other online service including when services are provided LIVE and used for the purpose of an Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s), appointment(s) is currently set at: $200.00 per person (25-minutes), and $125.00 for the group Contacting the Spirit World social, $20 Donation for the weekly Group Psychic-Development Circle, and when the payment is made in full, it will become a NON-REFUNDABLE and NON-TRANSFERABLE to any other service or event or person.

19. ATTENDANT understands that the total cost of the Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s) appointment(s) being provided once paid in full will become NON-REFUNDABLE and NON-TRANSFERABLE as explained in this agreement.

20. ATTENDANT fully understands that for any reason(s) known or unknown in advance, should he/she be unable to attend any one or group of scheduled Educational Lecture Series, one or more private or group psychic reading(s), hypnosis, and or wellness and life coaching session(s) appointment(s) and/or socials being offered, then he/she will be responsible for contacting the office at 239-244-1262 or write to drfaheyspeaking@yahoo.com no later than 24 hours prior to receive TIME CREDIT only that may be used for future services. Otherwise, the ATTENDANT will forfeit both the total time set aside for any one or more services paid for in advance and or for and the total amount of the total General admission cost paid by the ATTENDANT, and the BioHealth Counseling Center, Inc., and its Founder ROBERT A. FAHEY, M.Ed., Ph.D., will NOT be responsible in any way to make up such time or expense. All TIME CREDIT granted must be used within nigty (90) days of his or her last scheduled visit with Dr. Robert Allen Fahey, Ph.D. Otherwise, all monies paid and time reserved on TIME CREDIT will be automatically be forfeited by the ATTENDANT.

21. ATTENDANT is fully aware that for BioHealth Counseling Center, Inc., and its Founder ROBERT A. FAHEY, M.Ed., Ph.D., and its staff to service the ATTENDANT in a more efficient manner, all, or parts of only the group psychic events being given may be video or tape recorded for quality assurance, review purpose and control. Also ATTENDANT full understands that reporters, advertising personnel or others may take publicity photos for the purpose of future articles, newspaper, radio and television promotions and gives here and now authorization and full consent and permission of release of such without any form of compensation for such testimonial and/or photos should any be taken, reviewed and looked upon as acceptable and usable by the BioHealth Counseling Center, Inc., and its Founder ROBERT A. FAHEY, M.Ed., Ph.D.,

22. ATTENDANT fully understands that any service provided in the Educational Lecture Series, private or group psychic readings are held out to the public as non-therapeutic, defined as the use to only inculcate positive thinking and to not ever represent any services as any form of medical health care or psychotherapy, and despite research to the contrary, by law, may make no health benefit claims for such services.

It is strongly recommended that each ATTENDANT be on time on the specified date and time scheduled making sure they are in full attendance. Otherwise, they will be considered a “NO SHOW.”

Expectations

YOU DON’T ALWAYS GET WHAT YOU WANT, BUT YOU WILL ALWAYS GET WHAT YOU NEED! Go into your educational spiritual hypnosis session with only an open mind and heart knowing fully that sometimes it takes time to heal.

Any educational spiritual hypnosis service given by the REV. DR. ROBERT FAHEY is subject to the following terms and conditions:

1. Your session is solely for personal use.
2. No portion of your educational spiritual hypnosis session shall be used for your commercial benefit.
3. Any unauthorized commercial use by you shall violate Rev. Dr. Robert Fahey's rights, including but not limited to his right of publicity and privacy.
4. Your educational spiritual hypnosis session does not authorize you to use the Rev. Dr. Robert Fahey's name, voice, signature, photograph, or likeness in any manner, on or in products, merchandise, or goods, or for the purposes of advertising or selling, or soliciting purchases of, products, merchandise, goods or services.
5. Any unauthorized commercial use of the Rev. Dr. Robert Fahey's name, voice, signature, photograph, or likeness, in any manner, shall result in damages sustained by Rev. Dr. Robert Fahey.

CLIENT, ATTENDANT OR VENDOR FULLY UNDERSTANDS AND AGREES

Services: BioHealth Counseling Center, Inc., D/B/A Rev. Dr. Robert Fahey, D/B/A jobspirit.com, or any other site linked by the administrator owned exclusively by the Rev. Dr. Robert Fahey may from time to time, change the Terms and Conditions. You agree to review the Terms and Conditions and the relevant rules and regulations periodically and to be updated of such changes. Please note that your continued use of the Site and any one or more services following the changes of the Terms and Conditions constitutes acceptance of all such changes. Dr. Robert Fahey may change any Term or Condition policy or rule at any time, with no prior notice needed, even without cause. Privacy Statement: All Phone, Email, and Private Chat hypnosis session are kept completely private and confidential. We do not collect, sell, rent, or transfer sitter’s information or email addresses.
Confidentiality: Be it known that your email address, personal information, or the session material itself will never be discussed, sold, rented, shared, or given to anyone unless permission is given (see below for when permission is automatically inferred and granted).
Rights: We reserve the right to refuse a reading that goes against certain ethics and morals.
Medical/Legal Advice: Please seek a qualified healthcare professional if you are concerned about your health, have an illness/disease, or disorder as we do NOT give any medical and/or psychological advice. In addition, please seek an attorney for any legal or a judicial matter as we do NOT provide any legal advice.
Financial: Please seek only a qualified financial assistance from a banker, broker, or other financial institution if you have any financial concerns or any transactions as we are NOT a financial consultant service.
Unlimited Follow-up For Email Questions: FREE of charge provided a follow-up email is for questions posed in order to clarify an original purchased wellness life coaching answer already given, and NOT for additional questions. Additional questions require an additional purchase. Keep in mind what you pay for is the cost of time service desired.
PayPal: Other than making a payment for your reading through the United States Postal service, we use PayPal as our credit card and billing processor, as it offers a secure, reliable, and affordable solution for small businesses as well as flexibility of payment, privacy, and fraud protection for clients. Public and Private Media Photos/Movies: CLIENT, ATTENDANT, ATTENDANT OF A GIFT GALLERY OR EVENT, and or VENDOR who plans for, buys, and or who attends any one or more public and or private educational spiritual hypnosis and or psychic lectures or psychic services, or sittings fully understands and agrees that in order for the BioHealth Counseling Center, Inc., D/B/A Rev. Dr. Robert Fahey including any staff to service the CLIENT, ATTENDANT, ATTENDANT OF A GIFT GALLERY EVENT and or VENDOR in a more efficient manner, parts or all of the services presented may be video or tape recorded by different types of electronic devices for quality assurance, review purposes and control. More important, the CLIENT, ATTENDANT, ATTENDANT OF A GIFT GALLERY EVENT, and or VENDOR fully understands and agrees that only BioHealth Counseling Center, Inc., D/B/A Rev. Dr. Robert Fahey, D/B/A jobspirit.com, or any other site linked by the administrator owned exclusively by the Rev. Dr. Robert Fahey or appointed staff may take photos and or movies or tape recordings at any one event. NOTICE #3: AS THE STATE OF FLORIDA HAS NOT ADOPTED EDUCATIONAL AND TRAINING STANDARDS FOR THE PRACTICE OF HYPNOTISM, THIS STATEMENT OF CREDENTIALS IS FOR INFORMATIONAL PURPOSES ONLY.

Hypnotism is a self-regulating profession and its practitioners are not licensed by state governments. I am not a physician nor a licensed health care provider and may not provide a medical diagnosis nor recommend discontinuance of medically prescribed treatments. If a client desires a diagnosis or any other type of treatment from a different practitioner, the client may seek such services at any time. In the event, my services are terminated by a client, the client has a right to coordinate transfer of services to another practitioner. A client has a right to refuse hypnosis services at any time. A client has a right to know the expected duration of sessions, and may assert any right without retaliation.

Current Fees (may change without notice): The current per person charges and admission fees for my services allowing you into the sitting room for a private life couching hypnosis education session and or lectures series is set at: $200.00 per person and each session will last approximately thirty (25) minutes. When at least three (3) sittings are purchased at one time, then each session cost is $175.00 per person who come into any one or more sessions planned, and each session will last approximately thirty (30) minutes. There is a $525.00 per person fee for the 4-25-minute self-hypnosis maaster class, and a $1500.00 per event fee for the private 90-minute home and business group self-hypnosis social and when payment is made in full, this amount paid becomes automatically non-refundable and non-transferable to another person or date.

Confidentiality: I will not release any information to anyone without a written authorization from you, except as provided for by law. You have a right to be allowed access to my written record (should any exist) about you.

Insurance: I would suggest you think of my services as something of an investment that you will pay for personally. That will both protect your privacy and help you value the work you are doing more. In general, insurance companies do not like to cover hypnotic services, and I caution you not to expect them to do so.

The Approach: The educational spiritual life coaching hypnosis methods and services I offer are solution-centered focused and include training, speaking, lecturing and providing instructions with an approach that takes in consideration the whole person point of view. The main focus is to bring about an experience that releases positive and powerful wisdom from within for the attainment of personal and business goals. Methods may include hypnosis, self-hypnosis, nutrition and other knowledge to help achieve new personal positive motivation leading to greater success in whatever they do in life.

Notice #4: The services I render are held out to the public as a form of motivational coaching using non-therapeutic hypnosis and instruction in self-hypnosis. I do not represent my services as any form of health care or psychotherapy, and despite research to the contrary, by law I may make no health benefit claims for my services.

DR. ROBERT FAHEY AND MAKES NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM BIOHEALTH COUNSELING CENTER, INC., D/B/A DR ROBERT FAHEY, D/B/A JOBSPIRIT.COM, OR ANY OTHER SITE LINKED BY THE ADMINISTRATOR OWNED EXCLUSIVELY BY THE REV. DR. ROBERT FAHEY OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY

LIMITATIONS

IN NO EVENT WILL BIOHEALTH COUNSELING CENTER, INC., D/B/A DR ROBERT FAHEY, D/B/A JOBSPIRIT.COM, OR ANY OTHER SITE LINKED BY THE ADMINISTRATOR OWNED EXCLUSIVELY BY THE REV. DR. ROBERT FAHEY, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS AND THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES (COLLECTIVELY, "INDIRECT DAMAGES") ARISING OUT OF OR IN CONNECTION WITH OUR WEBSITE, THE SERVICES, OR THESE TERMS OF SERVICE (HOWEVER ARISING, INCLUDING NEGLIGENCE), EVEN IF BIOHEALTH COUNSELING CENTER, INC., D/B/A DR ROBERT FAHEY, D/B/A JOBSPIRIT.COM, OR ANY OTHER SITE LINKED BY THE ADMINISTRATOR OWNED EXCLUSIVELY BY THE REV. WITHOUT LIMITING THE FOREGOING, BIOHEALTH COUNSELING CENTER, INC., D/B/A DR ROBERT FAHEY, D/B/A JOBSPIRIT.COM, OR ANY OTHER SITE LINKED BY THE ADMINISTRATOR OWNED EXCLUSIVELY BY THE REV. DR. ROBERT FAHEY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT DAMAGES ARISING OUT OF OR IN CONNECTION WITH:

(A) THE USE OF OR THE INABILITY TO USE ANY ONE OF THE SERVICES PRESENTED;

(B) ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH BIOHEALTH COUNSELING CENTER, INC., D/B/A DR ROBERT FAHEY, D/B/A JOBSPIRIT.COM, OR ANY OTHER SITE LINKED BY THE ADMINISTRATOR OWNED EXCLUSIVELY BY THE REV. DR. ROBERT FAHEY, OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH BIOHEALTH COUNSELING CENTER, INC., D/B/A DR ROBERT FAHEY, D/B/A JOBSPIRIT.COM, OR ANY OTHER SITE LINKED BY THE ADMINISTRATOR OWNED EXCLUSIVELY BY THE REV. DR. ROBERT FAHEY

INDEMNIFICATION

You agree to indemnify, defend and hold harmless BioHealth Counseling Center, Inc., D/B/A Rev. Dr. Robert Fahey, D/B/A jobspirit.com, OR ANY OTHER SITE LINKED BY THE ADMINISTRATOR OWNED EXCLUSIVELY BY THE REV. DR. ROBERT FAHEY and its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from your use of any one or more of the site services.

ARBITRATION; INJUNCTIVE RELIEF

Any dispute, controversy, or claim arising out of, relating to, or in connection with this Agreement shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association ("AAA"). The arbitration shall be conducted by a single arbitrator, selected in accordance with the rules of the AAA, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. Notwithstanding the foregoing, either party has the right to seek any interim or preliminary relief from a court of competent jurisdiction in Florida in order to protect the rights of such party pending the completion of any arbitration hereunder, and both parties agree to submit to the exclusive jurisdiction of the courts of the State of Florida and venue in Palm Beach County, Florida for any such proceeding. If either party files an action contrary to this provision, the other party may recover attorneys' fees and costs up to one thousand US dollars (US $1000.00).

GENERAL PROVISIONS

These Terms of Service will be governed by and construed in accordance with the laws of the State of Florida without giving effect to any choice of law principles that would require the application of the laws of a different state.
